This Public Notice announces my decision regarding realignment of responsibility for regulatory functions in the Louisville and Detroit Districts. The new regulatory boundary in Indiana coincides with county boundaries to simplify the permit application process for the public, prospective applicants, and state and federal resource agencies. The U.S. Army Corps of Engineers has been delegated the authority to issue permits for work in the nation's waters pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. §403) and Section 404 of the Clean Water Act (33 U.S.C. §1344). Effective January 1, 2014, the Louisville District will assume full regulatory responsibility in Adams, Wells, Pulaski, White, and Benton counties in Indiana. The Detroit District will assume full regulatory responsibility in Allen, Whitley, Noble, Kosciusko, Marshall, Starke, and Jasper counties in Indiana. The public notice and map of the new aligment is available for viewing by clicking on the "Attachments" link above located in the upper right hand corner of this page. Only the duties under the regulatory authorities identitied above are being transferred. All Civil Works projects (such as Planning Studies and Lake Projects) will continue with the original district. This action does not affect the Chicago District regulatory boundary. New requests for regulatory actions (including applications for permits, requests for jurisdictional determinations, and reports of alleged unauthorized activities) after January 1, 2014, will be the responsibility of the district in accordance with the new boundaries.
