This notice describes an application submitted for a Department of the Army (DA) Permit, subject to Section 404 of the Clean Water Act. The project is being considered for authorization in accordance with 33 CFR 325.2(b) (2) and the procedures outlined in the “Letter of Permission for New Mitigation Projects Associated with Approved Compensatory Mitigation Banking and In-Lieu Fee Instruments”, I.D. No. LRL-2010-323.

LOCATION: On Harrison Fork (an intermittent stream), Nelson County, Kentucky.

PURPOSE: To provide aquatic habitat re-establishment, rehabilitation, and preservation and riparian habitat enhancement.
DESCRIPTION OF WORK: The Harrison Fork Restoration Project would re-establish approximately 4,222 linear feet and rehabilitate approximately 1,142 linear feet of Harrison Fork. The project would include the relocation and reconstruction of streams within an excavated floodplain and installation of in-channel habitat structures. Harrison Fork is a tributary of Wilson, which is a tributary of Rolling Fork of the Salt River. The project is within the Salt River Watershed Service Area.
The project would result in an estimated net gain of approximately 6,401 stream Adjusted Mitigation Units (AMU). The project area includes 61 acres owned by Isaac W. Bernheim Foundation. The stream re-establishment and rehabilitation area and riparian zone would be permanently protected through implementation of a conservation easement held by the Commonwealth of Kentucky under the stewardship of Kentucky Department of Fish and Wildlife Resources on approximately 19.4 acres.
In a letter dated March 12, 2010, the Kentucky State Historic Preservation Officer concurred with the consultant’s Phase 1 archaeological report. The Corp’s determination that the project, as proposed, would have “no adverse effect” to historic properties, contingent upon avoidance of two sites was sent to the Kentucky Heritage Council on December 20, 2021. No response from the Kentucky State Historic Preservation Officer was received.
In a letter dated March 17, 2017, the U.S. Fish and Wildlife Service (USFWS) concurred with the Corps’ determination that the project, as proposed, “may affect - not likely to adversely affect” the gray (Myotis grisescens), Indiana (Myotis sodalis), and northern long-eared (Myotis septentrionalis) bats, fanshell (Cyprogenia stegaria), northern riffleshell (Epioblasma tortulosa rangiana), snuffbox (Epioblasma triquetra), orangefoot pimpleback (Plethobasus cooperianus), and pink mucket (Lampsilis abrupta) mussels, and running buffalo clover (Trifolium stoloniferum).
