This notice describes an application submitted for a Department of the Army (DA) Permit, subject to Section 404 of the Clean Water Act. The project is being considered for authorization in accordance with 33 CFR 325.2(b)(2) and the procedures outlined in the “Letter of Permission for New Mitigation Projects Associated with Approved Compensatory Mitigation Banking and In-Lieu Fee Instruments”, I.D. No. LRL-2010-323. SPONSOR: The Northern Kentucky University Center for Environmental Restoration Stream and Wetland In-Lieu Fee Program 15 Clearview Drive Highland Heights, Kentucky 41076 LOCATION: On unnamed ephemeral and intermittent streams, on Scrubgrass Creek (a perennial stream), and on surrounding riparian habitat, located within two tracts (totaling 945 acres) in Nicholas County, Kentucky. Latitude: 38.328131 N Longitude: - 83.982233 W 7.5 Minute Quad: Moorefield PURPOSE: To provide aquatic habitat rehabilitation, enhancement and preservation, and riparian habitat restoration and preservation. DESCRIPTION OF WORK: The Kingsolver Stream Restoration Project Tracts 1 and 2 include two parcels with the following assigned I.D.s: LRL-2013-84 (540 acres) and LRL-2015-172 (405 acres). The project would include approximately 15,872 linear feet of rehabilitation, 1,511 linear feet of re-establishment, and approximately 46,130 linear feet of preservation of ephemeral, intermittent and perennial streams. The project would also restore and preserve adjacent riparian habitat. The project is estimated to generate 23,001 stream credits and would be permanently protected through transfer of the property to the Kentucky Department of Fish and Wildlife Resources and implementation of conservation deed restrictions on the restored streams and riparian areas. The unnamed ephemeral and intermittent streams are tributary to Scrubgrass Creek, which is a tributary to Cassidy Creek, which is a tributary to the Licking River, a Traditionally Navigable River (TNW). The Corps has determined that the proposed undertaking would have “no adverse effect on historic properties”. In a letter to the Kentucky State Historic Preservation Officer, dated May 28, 2015, the Corps requested concurrence with this determination. No response to the determination was received within 30 days; therefore, concurrence of the Corps’ determination is assumed. In accordance 36 C.F.R. §800.5(d)(1), 33 C.F.R. §325, Appendix C, Section (7)(c), and the Interim Guidance issued by the Corps of Engineers on April 25, 2005, obligations under Section 106 of the National Historic Preservation Act have been fulfilled. The Corps made a determination of “may affect, not likely to adversely affect” and “no affect” to critical habitat of four federally-listed taxa, Indiana (Myotis sodalis), Gray (Myotis grisescens) and Northern Long-eared (Myotis septentrionalis) bats, and Short’s Goldenrod (Solidago shortii). The project adheres to the conservation measures associated with the Kentucky Field Office’s 2016 Revised Conservation Strategy for Forest-Dwelling Bats and the 2015 Biological Opinion: Kentucky Field Office’s Participation in Conservation Memoranda of Agreement for the Indiana Bat and/or Northern Long-eared Bat. In a letter dated February 6, 2019, the U.S. Fish and Wildlife Service concurred with the Corps’ determination for the four federally-listed taxa. In the Biological Opinion dated February 6, 2019, Impacts to Running Buffalo Clover from the U.S. Army Corps of Engineers’ Approval of the Northern Kentucky University Center for Environmental Restoration Kingsolver Stream Restoration Project in Nicholas County, Kentucky, the U.S. Fish and Wildlife Service determined the project activity is “not likely to jeopardize the continued existence of” Running Buffalo Clover. Therefore, in accordance with the U.S. Fish and Wildlife Service letter, dated February 6, 2019, the obligations under Section 7 of the Endangered Species Act have been fulfilled for this proposal.
