Under new law landowners still required to follow process to resolve easement encroachments at Rough River Lake

Published Nov. 2, 2018
ROUGH RIVER LAKE, KY — The America's Water Infrastructure Act of 2018 was signed into law
on Oct. 23, 2018 which prohibits the government from collecting administrative fees for the processing
of landowners flowage easement encroachment resolutions and allows for the return of any
administrative fees already paid by landowners.

Even under this law, landowners will still be required to follow a process to obtain release of flowage
easements over their property to resolve identified flowage easement encroachments. This process
includes providing surveys, septic inspections, and copies of deeds. This law does not affect any fees
that landowners may have to pay or have paid to other parties for these surveys, septic inspections or
copies of deeds.

The Corps of Engineers will continue to work with landowners as we move through this process. If you
have any questions, contact the U.S. Army Corps of Engineers, Rough River Lake Project Office at
(270) 257-2061.
