This notice describes an application submitted for a Department of the Army (DA) Permit, subject to Section 404 of the Clean Water Act. The project is being considered for authorization in accordance with 33 CFR 325.2(b) (2) and the procedures outlined in the “Letter of Permission for New Mitigation Projects Associated with Approved Compensatory Mitigation Banking and In-Lieu Fee Instruments”, I.D. No. LRL-2010-323.
SPONSOR: The Kentucky Dept. of Fish and Wildlife Resources Stream and Wetland In-Lieu Fee Program #1 Sportsman’s Lane Frankfort, Kentucky 40601 LOCATION: On unnamed ephemeral and intermittent streams, Ross Creek (a perennial stream), and adjacent wetlands in Lee and Estill Counties, Kentucky.
Latitude: 37.60333 N Longitude: -83.85833 W 7.5 Minute Quad: Heidelberg PURPOSE: To provide aquatic habitat re-establishment, rehabilitation, enhancement, preservation.
DESCRIPTION OF WORK: The Ross Creek Stream and Wetland Restoration Phase I & II Project would preserve 10,494 liner feet, rehabilitate 3,836 linear feet and re-establish 13,016 liner feet of ephemeral, intermittent and perennial streams and rehabilitate 20.9 acres, re-establish 0.22 acres and establish 7.85 acres of forested wetland adjacent to Ross Creek. The project is within the Upper Kentucky River Watershed Service Area.
The wetlands are adjacent to Ross Creek. The unnamed ephemeral and intermittent streams flow into Ross Creek, a perennial stream. Ross Creek flows to the Kentucky River. The Kentucky River is a Traditionally Navigable Water.
The project would result in an estimated net gain of 6,773 Ecological Integrity Units (EIUs) and 5.95 wetland Adjusted Mitigation Units (AMUs). The project area, including a 150-foot buffer surrounding all streams, would be permanently protected through implementation of conservation deed restrictions on an approximately 640-acre site owned by the Sponsor.
In a letter dated July 2, 2013 the Kentucky State Historic Preservation Officer concurred with the recommendation of “no adverse effect” to historic properties, contingent upon avoidance of three sites.
In a letter dated May 22, 2015, the U.S. Fish and Wildlife Service stated that the project, as proposed, “may affect - not likely to adversely affect” the gray (Myotis grisescens), Indiana (Myotis sodalis), northern long-eared(Myotis septentrionalis) and Virginia big-eared (Corynorhinus townsendii virginianus) bats, snuffbox mussel (Epioblasma triquerta) and the Kentucky arrow darter (Etheostoma sagitta spilotum). The letter also stated that the project would have “no effect” on the designated critical habitat for the Indiana or Virginia big-eared bats.
