This notice describes an application submitted for a Department of the Army (DA) Permit, subject to Section 404 of the Clean Water Act. The project is being considered for authorization in accordance with 33 CFR 325.2(b) (2) and the procedures outlined in the “Letter of Permission for New Mitigation Projects Associated with Approved Compensatory Mitigation Banking and In-Lieu Fee Instruments”, I.D. No. LRL-2010-323.

LOCATION: On ephemeral, intermittent and perennial streams and surrounding riparian habitat (totaling 121 acres) located in Nelson County, Kentucky.

PURPOSE: To provide aquatic habitat re-establishment, rehabilitation, enhancement and preservation and riparian habitat restoration and enhancement.
DESCRIPTION OF WORK: The Big Lick Hollow Stream Restoration Project would include re-establishment, rehabilitation, enhancement, and preservation of approximately 25,064 linear feet of ephemeral, intermittent, and perennial streams within the Salt River watershed. The project would also restore and preserve adjacent riparian habitat. The project is estimated to generate 23,157 stream Adjusted Mitigation Units (AMUs) (credits) and would be permanently protected through implementation of a conservation easement held by the Kentucky Waterways Alliance (KWA). All incompatible uses, including mineral extraction, would be prohibited. The ephemeral, intermittent and perennial streams are tributary to Cane Run, which is a tributary to the Rolling Fork River, which is a tributary to the Salt River, a Traditionally Navigable Water (TNW).
The Corps reviewed the project proposal for compliance with Section 106 of the National Historic Preservation Act (NHPA) and determined that the project has "No Potential to Affect Historic Properties". Therefore, in accordance with 36 CFR 800.3(a)(1), Appendix C, Section (3)
(b), USACE Interim Guidance April 25, 2005, Section 106 is complete and no consultation with the Kentucky State Historic Preservation Officer is required.
In a letter dated September 26, 2022, the U.S. Fish and Wildlife Service (USFWS) concurred with the Corps’ determination that the project, as proposed, “may affect - not likely to adversely affect” the gray (Myotis grisescens), Indiana (Myotis sodalis), and northern long-eared (Myotis septentrionalis) bats, as well as, Clubshell (Pleurobema clava), Fanshell (Cyprogenia stegaria), Orangefoot Pimpleback (pearlymussel) (Plethobasus cooperianus), pink mucket (Lampsillis abrupta), rabbitsfoot (Theliderma Cylindrica), Ring Pink (mussel) (Obovaria retusa), and snuffbox (Epioblasma triquetra) mussels.
This Public Notice initiates the 30-day post-certification process regarding the determination of effects on neighboring jurisdictions with the Environmental Protection Agency (EPA).
