This notice describes an application submitted for a Department of the Army (DA) Permit, subject to Section 404 of the Clean Water Act. LOCATION: On unnamed ephemeral, intermittent, and perennial streams, adjacent wetlands and on surrounding riparian habitat, located within two tracts (totaling approximately 90 acres) in Hamilton County, Indiana.

PURPOSE: To provide aquatic habitat establishment, rehabilitation, enhancement and preservation, and riparian habitat restoration and preservation.
DESCRIPTION OF WORK: The project would include 6,276 linear feet of stream rehabilitation, 268 linear feet of stream re-establishment, 157 linear feet of stream creation, and 3,840 linear feet of riparian habitat enhancement. Additionally, the project would result in the re-establishment of 9.85 acres of wetlands, rehabilitation of 1.62 acres of wetlands, 1.44 acres of wetland enhancement, 25 acres of buffers and preservation of 31.23 acres. The project is estimated to generate 17.64 wetland credits and 7,424 stream credits and would be permanently protected through a conservation easement with IDNR and the Hamilton County Parks Service. The ephemeral, intermittent, and perennial streams are tributaries to Hinkle Creek.
The Corps has determined that the proposed undertaking would have “no adverse effect on historic properties. In a letter to the Indiana State Historic Preservation Officer (SHPO), dated October 28, 2021, the Corps requested concurrence with this determination. In a letter dated November 24, 2021, the SHPO requested additional information being prepared by the Agent with regards to archeological resources. In a second letter, dated January 6, 2022, following receipt of the additional information, the SHPO stated the archeological resources onsite were not eligible for listing and no additional work was necessary. In accordance 36 C.F.R §800.5(d)(1), 33 C.F.R. §325, Appendix C, Section (7)(c), and the Interim Guidance issued by the Corps of Engineers on April 25, 2005, obligations under Section 106 of the National Historic Preservation Act have been fulfilled.
The Corps made a determination of “not likely to adversely affect” for the federally-listed Indiana (Myotis sodalis) and northern long-eared (Myotis septentrionalis) bats and critical habitat. In an email dated September 22, 2021, the U.S. Fish and Wildlife Service concurred with the Corps finding. Therefore, the obligations under Section 7 of the Endangered Species Act have been fulfilled for this proposal.
